GDPR and your personal data

The majority of the personal data we collect is through our Mailchimp surveys. We also collect data to help us deliver and improve our services. This includes:

  • Activity evaluation forms that we use to review and improve the quality of our activities.
  • Customer satisfaction surveys, to help us improve the services we offer to the public.
  • Email lists, so we can keep people updated with events and activities that may interest them.
  • Analytical data about website and social media users.

Much of this data is anonymised or aggregated for analytical purposes.

Lerwick 28 is a project of Shetland Arts Development Agency. Shetland Arts is responsible for determining how and why personal data collected through Lerwick 28 is used.

We currently collect the following personal data as part of our standard surveys:

  • Customer name
  • Email address

Under UK data protection law, personal data can be collected and processed for a number of reasons. Lerwick 28, as a project of Shetland Arts, collects and processes data under the following basis:

Consent

Shetland Arts performs specific processing activities, such as marketing emails, only with the express consent of the customer to do so.

At Lerwick 28, we are committed to making it as straightforward as possible for you to be in control of the data we might have on record about you.

Everyone has the right to ask us if we have any personal data about them, and we will let them know as soon as we can.

You can ask us to delete personal data we hold about you, where you have the right to do so under data protection law.

Your rights

As defined in UK data protection law, including UK GDPR Articles 12–23, you have a number of rights, including:

  • The right to be informed about the collection and use of your personal data. This is outlined above and in our Privacy Policy.
  • The right to access the information we hold about you, also known as a Subject Access Request (SAR).
  • The right to request rectification of any inaccurate personal data we hold about you.
  • The right to request erasure of your personal data in certain circumstances.
  • The right to restrict processing of your personal data in certain circumstances.
  • The right to object to certain processing of your personal data.

In certain circumstances, exemptions to these rights may apply.

Do you have a complaint?

If you consider that your personal data has been misused or mishandled by us, you can raise this with Shetland Arts in the first instance.

If you remain dissatisfied, you can make a complaint to the Information Commissioner’s Office (ICO), which is an independent regulator.
